Povzetek
Policija ima pri svojem delu na voljo različna pooblastila, s katerimi zagotavlja red in mir v državi. Eno izmed možnih pooblastil je tudi odvzem prostosti. Pri tem gre za najgloblji poseg v osebno svobodo, ki ga policija lahko izvrši le takrat, ko je to neizogibno potrebno in ko so izpolnjeni vsi zakonsko določeni pogoji. V predkazenskem postopku je to takrat, ko ima policija dovoljšno stopnjo suma, da je določena oseba storila kaznivo dejanje.
Pri pisanju diplomske naloge smo se osredotočili na odvzeme prostosti, ki so definirani v Zakonu o kazenskem postopku, to so prijetje, privedba in pridržanje. Odvzemov prostosti pa ne vsebuje le Zakon o kazenskem postopku, zato smo opisali pridržanje tudi po Zakonu o prekrških, Zakonu o nalogah in pooblastilih policije in Zakonu o pravilih cestnega prometa.
Opredelili smo tudi pravico do osebne svobode, ki je zavarovana v različnih mednarodnih dokumentih in v Ustavi Republike Slovenije. Prav tako ima oseba, ki ji je odvzeta prostost, po Ustavi in Zakonu o kazenskem postopku zagotovljene pravice, s katerimi jo mora policist seznaniti takoj ob odvzemu prostosti. Poleg teh pravic smo v diplomski nalogi pogledali še ostale pravice, ki pripadajo osebi, ki ji je bila odvzeta prostost.
Analizirali smo tudi Ustavno odločbo U-I-18/93, saj se je zaradi nje prvič moral spremeniti Zakon o kazenskem postopku, ker ni bil v skladu z Ustavo.
V zaključku ugotavljamo vlogo okrožnega državnega tožilca v predkazenskem postopku pri odvzemu prostosti, kako so urejeni posegi v osebno svobodo posameznika in kakšne pravice ima posameznik, ki mu je bila odvzeta prostost.

The police have various authorizations in their work to ensure peace and order in the country. One of the possible authorizations is the deprivation of liberty. In addition, this is the most profound encroachment upon personal freedom, which the police can execute only when this is indispensable and when all the conditions required by law are met. In the pre-trial criminal procedure, this is when the police have a sufficient degree of suspicion that a certain person has committed a criminal offense.
In the diploma thesis writing, we focused on deprivations of liberty, which are defined in the Criminal Procedure Act, namely arrest, transfer and detention. The deprivations of liberty are not a part of the Criminal Procedure Act alone, therefore we also described detention under the Minor Offenses Act, the Police Tasks and Powers Act and the Road Traffic Rules Act.
We also defined the right to personal liberty, which is protected in various international documents and the Constitution of the Republic of Slovenia. In addition, a person deprived of liberty under the Constitution and the Criminal Procedure Act has the rights that the police officer must acquaint with the person as soon as he or she is deprived of his or her liberty. In the diploma thesis, in addition to these rights, we also examined other rights that belong to the person who was deprived of liberty.
We also analysed the Constitutional Decision U-I-18/93, since it was for the first time that the Criminal Procedure Act had to be amended because it was not in accordance with the Constitution.
In conclusion, we determine the role of the district state prosecutor in the pre-trial detention procedure, how interventions into the individual's freedom are organized, and what are the rights of an individual that has been deprived of freedom. |
