Povzetek
Mednarodna trgovinska arbitraža predstavlja favoriziran način reševanja sporov med mednarodnimi strankami, vendar sam postopek arbitraže skriva številne procesne pasti. Ena od teh je vprašanje dopustnosti dokazovanja z nezakonito pridobljenimi dokazi, ki lahko eventualno pripeljejo eno od strank do zmage v postopku in znatnih odškodnin, ki se lahko merijo v desetinah milijonov evrov. Vprašanje dopustnosti nezakonitih dokazov v teoriji in praksi ni razčiščeno, nekateri teoretiki pa tehtanje, ali dokaz dopustiti ali ne, predstavljajo kot tehtanje med dvema temeljnima pravicama, ki jih imajo stranke v arbitražnem postopku - pravico do izjave in pravico do enakopravnosti.
Magistrsko delo zato skuša odgovoriti na vprašanje dopustnosti uporabe nezakonito pridobljenih dokazov v mednarodni trgovinski arbitraži in na vprašaje o možnosti zavrnitve priznanja tuje oz. izpodbijanja domače arbitražne odločbe v Sloveniji zaradi upoštevanja oz. zavrnitve takih dokazov. To delo najprej povzame vse vire, ki urejajo, ali vplivajo na dokazni postopek v arbitraži, nato pa skozi teorijo in zanimivejše primere arbitražne prakse poskuša orisati meje dopustnosti in določiti nekatera generalna načela. Temu sledi preučevanje možnosti zavrnitve priznanja arbitražne odločbe v Sloveniji iz razlogov, ki jih podajata b točki prvega in drugega odstavka V. člena Newyorške konvencije o priznanju in izvršitvi tujih arbitražnih odločb. Delo se zaključi s povzetkom, ki predstavi ugotovitve prejšnjih poglavij in razmišljanje avtorja.

International commercial arbitration presents the preferred method of dispute resolution between international parties, however numerous procedural pitfalls lurk in the arbitral procedure. One of these is the question of admissibility of illegally obtained evidence, the use of which can eventually lead to one party winning and claiming damages that can amount to tenths of millions of euros. The admissibility of illegally obtained evidence is not yet clear neither in theory or in practice, whereas several authors describe the weighing of admission or non-admission as the weighing between two fundamental rights in the arbitral procedure – the right to be heard and the right to equality of parties.
This master thesis therefor undertakes to answer the question of admissibility of illegally obtained evidence in international commercial arbitration and the question of whether an arbitral decision would be denied recognition or be annulled and therefore unenforceable in the Republic of Slovenia due to either admitting or refusing illegally obtained evidence. This thesis firstly summarises all legal and soft law sources that play a role in the evidentiary procedure in arbitration and afterwards tries to define some red lines and general principles throughout the existing theory and relevant and interesting arbitral jurisprudence. This is followed by the examination of the possibility of denial of recognition of the arbitral award on the basis of point b of the first and second paragraph of Article V of the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. The thesis concludes with a summary which presents the findings and the concluding remarks of the author. |
