Povzetek
Zdravje je ena iz med najpomembnejših vrednot posameznika in hkrati tudi ena od temeljnih človekovih pravic. Zagotavljanje te pravice je možno le z uporabo ustreznih zdravil in medicinskih pripomočkov. Povpraševanje po medicinskih izdelkih je zelo veliko, zato neustrezno zagotovljen dostop do njih ustvari priložnosti za izvajanje kriminalnih dejavnosti in pridobitev nezakonitih finančnih sredstev. Ponarejeni medicinski izdelki resno ogrožajo človekovo zdravje in življenje. Storilci s ponudbo ponarejenih medicinskih izdelkov sledijo povpraševanju in zapolnijo nastale vrzeli. Slednje se je pokazalo tudi v času pandemije virusa SARS-CoV-2, saj so zahteve po zaščitnih sredstvih zelo hitro presegle zaloge. Ključni pospeševalec prometa s ponarejenimi medicinskimi izdelki je razvoj spleta, ki omogoča širjenje spletne prodaje in omogoča storilcem prikrivanje njihove prave identitete. V diplomski nalogi smo opisali problematiko in prikazali obseg ponarejenih medicinskih izdelkov ter raziskali vpliv pandemije na promet s ponarejenimi medicinskimi izdelki. S fokusom na pandemijo virusa SARS-CoV-2 smo se lotili pregleda literature, iskanja statističnih podatkov in njihove analize. Ugotavljamo, da so razmere, povzročene zaradi pandemije, omogočile povečano delovanje storilcev na področju ponarejanja zdravil in medicinskih pripomočkov ter porast v prometu s ponarejenimi medicinskimi izdelki. Problematiko povezujemo tudi z organiziranim kriminalom, ki razprostira svoje lovke po celem svetu, zato mora biti temu ustrezen odziv organov pregona in celotne družbe. Neenotni zakonski okviri in neustrezno naslavljanje problematike ter šibkost nekaterih organov in institucij onemogočajo uspešen pregon kaznivih dejanj, povezanih s ponarejanjem medicinskih izdelkov in njihovih storilcev, zato je potrebno stremeti k pravni ureditvi tega področja in medsebojnemu sodelovanju.

Counterfeit medical products during SARS-CoV-2 pandemic |

Health is one of the most important values of any individual – and, at the same time, a fundamental human right. This right can only be ensured through appropriate use of medicines and medical products. Demand for medical products is very high, and inappropriate access to them creates opportunities for criminal activities and acquisition of illicit assets. Counterfeit medical products pose a serious threat to health and human life. By supplying counterfeit medical products, perpetrators follow the demand and fill the gaps created. The latter was also visible during the SARS-CoV-2 pandemic, as the demand for medical products quickly exceeded the supply. The Internet’s development and growth is a key accelerator of trafficking of counterfeit medical products, as it allows online sales to proliferate and enables perpetrators to conceal their true identities. In this thesis, we describe the problem and illustrate the scale of counterfeit medical products. Focusing on the SARS-CoV-2 pandemic, we undertook a literature review, searching for statistical data and analysing them. We conclude that the situation caused by the pandemic has facilitated an increase in the activity of perpetrators in the field of counterfeit medicines and medical products, and a rise in trafficking of counterfeit medical products. We also link the problem to organized crime, which is spreading its tentacles across the globe. Thus, it requires an appropriate response from the law enforcement authorities and society as a whole. The fragmented legal framework and inadequate addressing of the issue, as well as the weakness of particular authorities and institutions, make it impossible to successfully prosecute crimes linked to counterfeit medical products and their perpetrators. Thus, it is necessary to strive for the legal regulation of this area and mutual collaboration. |
