Povzetek

Področje temeljnih pravic otrok s posebnimi potrebami v izobraževalnem sistemu je v Sloveniji urejeno v številnih mednarodnih in nacionalnih pravnih aktih. Med osnovne pravice spada zagotavljanje enakih možnosti, nediskriminacija, spoštovanje in sprejemanje različnosti ter dostop do vključujočega izobraževanja. V realnem življenju pa pogosto prihaja do težav pri zagotavljanju teh pravic, na kar Slovenijo opozarjajo tudi mednarodni organi, kot je na primer Odbor ZN za pravice invalidov. V pričujočem diplomskem delu preučujemo temeljne pravice otrok s posebnimi potrebami v izobraževalnem sistemu preko pregleda pravnih in zakonodajnih podlag ter s pomočjo lastne raziskave. Želeli smo ugotoviti, v kolikšni meri so starši seznanjeni s pravicami svojih otrok s posebnimi potrebami na področju izobraževanja, kako pogosto se srečujejo s kršitvami teh pravic, kako le-te vplivajo na odnose in kakovost življenja v njihovih družinah ter kakšne spremembe izobraževalnega sistema bi bile potrebne, da bi se zagotavljale pravice otrok s posebnimi potrebami do enakovrednega izobraževanja. Na vprašanja smo odgovorili s pomočjo kvalitativne raziskave, pri kateri smo uporabili polstrukturirane intervjuje. Naše sogovornice so bile matere otrok s posebnimi potrebami, ki smo jih izbrali namensko po principu snežene kepe. Zbrane podatke smo vsebinsko analizirali v spletni aplikaciji Atlas.ti. Ugotovili smo, da so bile naše sogovornice zelo pomanjkljivo obveščene o pravicah svojih otrok s posebnimi potrebami, da so si informacije večinoma poiskale same, tj. preko spleta ali socialnih omrežij, da so bile kršitve pravic njihovih otrok pogoste ter da so imele negativne posledice za otroke in družine. Predvsem problematično je dejstvo, da je usoda otrok s posebnimi potrebami v izobraževalnem sistemu pogosto odvisna od posameznih učiteljev ali drugih strokovnih delavcev, ki ne sprejemajo vključujočega izobraževanja. V izobraževalnem sistemu so spremembe, ki bi zagotavljale spoštovanje pravic otrok s posebnimi potrebami, nujne.

Sekundarni povzetek: The fundamental rights of children with special needs in the education system are regulated in Slovenia in a number of international and national legislation. Fundamental rights include equal opportunities, non-discrimination, respect and acceptance of diversity and access to inclusive education. However, in real life, there are frequent problems in guaranteeing these rights, which have also been pointed out to Slovenia by international bodies such as the UN committee on the rights of persons with disabilities. In this thesis, we examine the fundamental rights of children with disabilities in the education system through a review of the legal and legislative framework, and through our own research. We wanted to find out to what extent parents are aware of the rights of their children with special needs in the field of education, how often they encounter violations of these rights, how these affect the relationships and quality of life in their families, and what changes to the education system would be necessary to guarantee the rights of children with special needs to an equal education. The questions were answered through qualitative research using semi-structured interviews. Our interviewees were mothers of children with disabilities, who were purposively selected using the snowball sampling technique. The collected data were analysed in the Atlas.ti web application. We found that our interviewees were very poorly informed about the rights of their children with disabilities, that they mostly sought information on their own, online or through social networks, that violations of their children's rights were frequent and that they had negative consequences for children and families. Particularly problematic is the fact that the fate of children with disabilities in the education system often depends on individual teachers or other professionals who do not embrace inclusive education. It is necessary to adopt changes in the education system to ensure that the rights of children with special needs are respected.
