Povzetek
Namen diplomskega dela je bil preučiti temeljne novosti, ki jih prinaša Zakon o katastru nepremičnin (ZKN, 2021) skupaj s podzakonskimi akti na področju katastrske storitve vpisa stavbe in delov stavbe v kataster nepremičnin. Z namenom predstavitve ključnih sprememb smo izvedli podrobno analizo zakonskega okvira in izbranih elaboratov te katastrske storitve. Na temelju analize smo ugotovili, da so se z novo zakonodajo uveljavile številne postopkovne novosti in vsebinske spremembe glede na predhodna določila Zakona o evidentiranju nepremičnin (ZEN, 2006). Bistvena je predvsem sprememba osnove za povezavo parcele in stavbe, ki je ne predstavlja več tloris zemljišča pod stavbo, temveč jo opredeljuje tloris stavbe. Prav tako je ključna novost uveljavitev pojma neposredne bližine. Novosti naj bi pripomogle k učinkovitejšemu vpisu pravih in popolnih podatkov o stavbah in njenih delih, v povezavi z zemljiškimi parcelami, v kataster nepremičnin, v kolikor bodo v praksi dosledno upoštevane

Analysis of the novelties of building registration in the real property cadastre from 2022 |

The aim of this thesis is to present fundamental innovations brought by the Real Estate Cadastre Act (2021) along with its regulatory provisions in the field of cadastre services, concerning the registration of buildings and parts of buildings in the real estate cadastre. In order to present these key changes, we conducted a detailed analysis of the legal framework and selected documentation related to this cadastre service. Based on the analysis, we determined that the new legislation has introduced numerous procedural novelties and substantive changes compared to the previous provisions of the Real Estate Records Act (2006). Particularly significant is the change in the basis for determining the relation between land parcel and a building, which is no longer represented by the ground plan of the land under the building but is defined by the ground plan of the building itself. Another significant novelty is the introduction of the concept of immediate proximity. All these novelties are introduced to contribute to more efficient registration of accurate and complete data about buildings and their belonging parts in relation to a land parcel in the real estate cadastre, provided they are consistently adhered to. |
