Povzetek
Posredovanje v prometu z nepremičninami je po letu 1990 postalo zelo dobičkonosna dejavnost. Lotil se je je lahko praktično vsakdo, ne glede na znanje in usposobljenost. Zaradi neetičnega obnašanja posameznih nepremičninskih posrednikov, ki so metali slabo luč na celotno panogo, je prišlo do oškodovanja posameznikov in poseg zakonodajalca je bil nujen. Z namenom ureditve opravljanja dejavnosti nepremičninskega posredovanja in posledično tudi povečanja varnosti uporabnikov teh storitev je bil spomladi leta 2003 sprejet Zakon o nepremičninskem posredovanju .
Diplomska naloga tako obravnava zgodovino nepremičninskega posredovanja, primerjavo nepremičninskega posredovanja v Sloveniji z drugimi državami ter sprejetje omenjenega zakona. Osrednji del diplomske naloge zajema Zakon o nepremičninskem posredovanju. V skladu z obravnavano tematiko diplomska naloga predstavi pojme, ki jih zasledimo v zakonu, pogoje, ki jih morajo izpolnjevati nepremičninske družbe in nepremičninski posredniki, obveznosti nepremičninskih družb, dolžnosti naročiteljev storitve, pravico nepremičninske družbe do plačila za posredovanje.
Skozi sodno prakso ugotavljamo tudi pomanjkljivosti zakona. V zadnjem delu pa so predstavljeni predlogi sprememb zakona.

Real estate business has been very profitable activity in Slovenia after 1990. Almost everyone could get involved into the real estate business regardless of their skills or competence. Because of the unethical behavior of some real estate brokers some clients got deceived and as a result of that the legislators had to intervene. In the spring of 2003 Real Estate Brokerage Act was passed to regulate the business of real estate brokers as well as to protect the real estate clients.
This thesis also deals with the history of the real estate brokerages in Slovenia, comparison of the real estate businesses in Slovenia with the other countries and the adoption of the said law. The central part of the thesis covers the Real Estate Brokerage Act. In accordance with the title subject the thesis presents the concepts of the law, the conditions that need to be met by the real estate companies and the brokers, the obligations of the real estate companies and the duties of the real estate clients, as well the right to receive payments for the real estate services for providing services to their clients.
Through the case law we are noticing the shortcomings of the current Act. The last section of the thesis deals with the proposed amendments to the Real Estate Brokerage Act. |
