Povzetek
Diplomsko delo z naslovom Evropsko potrdilo o dedovanju obravnava Uredbo (EU) št. 650/2012 Evropskega parlamenta in Sveta o pristojnosti, pravu, ki se uporablja, priznavanju in izvrševanju odločb in sprejemljivosti in izvrševanju javnih listin v dednih zadevah ter uvedbi evropskega potrdila o dedovanju (Uredba o dedovanju). Uredba o dedovanju je obsežna, zato sem izbrala samo določene teme. Osredotočila sem se predvsem na evropsko potrdilo o dedovanju ter opredelitev izraza sodišče, ki ga uporablja Uredba o dedovanju. V prvem delu diplomskega dela je predstavljena pot do sprejetja Uredbe o dedovanju. Harmonizacija pravil na področju dednega prava je bila dolgoletna želja oziroma cilj, saj so se v primerih z mednarodnim elementom pojavljale številne težave, predvsem za dediče. Največji korak nasproti temu je bila predstavitev Zelene knjige Dedovanje in oporoke, v kateri je komisija predstavila problematiko na področju dedovanja in prikazala ustrezne rešitve. V nadaljevanju diplomsko delo na kratko predstavlja Uredbo o dedovanju, tako da se lahko bralec na kratko seznani z njeno vsebino. Diplomsko delo vključuje tudi razlago izraza sodišče, ki ga uporablja Uredba o dedovanju, ter v skladu s tem kratko predstavitev pravnih sistemov nekaterih drugih držav članic in opredelitev organov, ki v teh državah članicah v skladu z uredbo spadajo pod pojem sodišča, saj se Uredba o dedovanju ne osredotoča zgolj na ozko razlago pojma sodišče. Kateri organi so pristojni v zapuščinskih zadevah pa je odvisno ali so zapuščinski postopki urejeni kot sodni ali izvensodni postopki. Najbolj pomembna novost Uredbe o dedovanju pa je prav zagotovo Evropsko potrdilo o dedovanju, s katerim je dedičem, volilojemnikom z neposrednimi pravicami v dedni zadevi in izvršiteljem oporoke ali upraviteljem zapuščine olajšano uveljavljanje pravic v drugi državi članici, saj potrdilo učinkuje, ne da bi za to bil potreben kakršenkoli poseben postopek. Evropsko potrdilo bo tako postalo nujno oziroma koristno za državljane Evropske unije, da dokažejo njihov status in uveljavijo pravice in pristojnosti v državi članici, obenem pa bo priložnost za notarje in organe, ki se soočajo z mednarodnim nasledstvom, da odstranijo težave, ki se pojavljajo pri razpravah o teh nasledstvih.

Diploma paper, titled European Certificate of Succession treatment Regulation of the european parliament and of the council on jurisdiction, applicable law, recognition and enforcement of decisions and authentic instruments in matters of successions and on the introduction of a european certificate of succession Regulation on succession is extensive, so I chose only certain topics related to European certificate of succession and definition of the term court that European certificate of succession uses.
First part of the diploma paper introduces means how the Regulation on succession was passed. Harmonization of rules in law of succession was a long-term goal or wish, because there were several issues in international elements, especially regarding the heirs. The biggest step towards solution was the introduction of Green paper on succession and wills, where the Commision introduces the issues regarding succession and introduces corresponding solutions. Furthermore, the diploma paper shortly introduces Regulation on succession, so the reader is familiarized with the contents.
Diploma paper also presents the definition of the term court, which Regulation on succession uses, and also a short presentation of legal systems of some other member states and also the definition of authorities in these member states that according to regulation fall under the term court. Because Regulation on succession doesn't concentrate only on the interpretation of the term court.
Authorities which are competent in matters of succession depend on whether the succession proceedings are regulated as judicial or non-judicial procedures.
The most important novelty of Regulation on succession is certainly European certificate on succession, in which heirs, legatees with direct rights in succession and executors of will or administrators of the estate facilitate exercising their rights in other member states, because the certificate is effective without any special procedures needed.
European certificate of succession will become the necessity and also beneficial for citizens of European Union, since it will show the status in enforcing the rights in jurisdiction of the member state. It will also be an opportunity for public notaries and other authorities in international law of succession to avoid issues that come across in succession hearings. |
