Povzetek
Ekskluzija dokazov je institut, ki izvira iz anglosaškega akuzatornega sistema kazenskega postopka, razvilo pa ga je Vrhovno sodišče ZDA. Bistvo obravnavanega instituta je v tem, da prepreči, da bi se nezakonito ali protiustavno pridobljeni dokazi lahko uporabili v kazenskem postopku. Obstajata dva glavna teoretična pristopa k ekskluziji dokazov, in sicer utilitaristično pojmovanje in načelno oziroma dosledno pojmovanje. V Sloveniji je uzakonjena dosledna ekskluzija dokazov, kar pomeni, da je potrebno vsak dokaz, ki je bil pridobljen s kršitvijo človekovih pravic in temeljnih svoboščin izločiti iz sodnega spisa, sodna odločba pa se nanj ne sme opreti. Vendar pa je slovenska sodna praksa prikazala odklon od te ureditve z uporabo metode tehtanja, in sicer s tehtanjem med kršeno ustavno pravico obdolženca in varovano pravico posameznika, ki je dokaz pridobil s posegom v pravico, ter tehtanje med prizadeto ustavno pravico obdolženca in javnim interesom za učinkovit pregon kaznivih dejanj, če je dokaze s posegom v pravico obdolženca pridobil državni organ. Poleg tega je sodna praksa pokazala odklon tudi z uporabo štirih izjem, ki jih je v zvezi z doktrino »sadežev zastrupljenega drevesa« izoblikovalo Vrhovno sodišče ZDA: izjema dobre vere, neizogibnega odkritja, neodvisnega vira in zbledelega madeža.

Exclusion of evidence is a legal concept that originates from the Anglo-Saxon accusatory system and was developed by the US Supreme Court. The essence of this legal concept is, that it prevents illegally or unconstitutionally obtained evidence to be used in criminal proceedings. There are two main theoretical approach to the exclusion of evidence; the utilitarian approach and the principle based or absolute approach. Slovenia has an absolute exclusionary rule by law, which means that it is necessary that any evidence that has been obtained with the violation of human rights and fundamental freedoms must be removed from the case file and the court decision must not be based on such evidence. Slovenian jurisprudence has shown deviation from this principle using two methods of weighing. First method uses weighing between the constitutional right of the accused that has been violated and the constitutional right of the person who obtained the evidence thrugh such violation. Second method uses weighing between constitutional right of the accused that has been violated and public interest for effective prosecution, if evidience were obtained from the state authority with the violation of the constitutional right of the accused. Moreover, the case law shows deviation with the use of the four exceptions that ware developed by US Supreme Court, namely the good faith doctrine, the inevitable discovery doctrine, the independent source doctrine and purged taint doctrine. |
