Secondary title: Management of construction deviations based on FIDIC contract conditions
Secondary abstract: Construction is a challenging and long-term process during which situations causing deviations and disagreements between the contracting parties might occur. One of the possible reasons for such occurrences is a poorly prepared construction contract. By signing it the constructor binds himself to carry out the work whereas the customer binds himself to pay the constructor a certain price for the given service. It is for this reason that the contract should be written carefully and thoughtfully. My diploma thesis is divided into two parts. In the first part I will focus on theoretical references and general terms which are used to regulate contracting relations between the parties and are applicable to the Slovenian legislation. How contracting relations are regulated by the international organisation FIDIC will also be presented. Firstly I will provide a description of the general FIDIC conditions, their applicability and their development through history as well as their compatibility with the Slovenian legislation. In the second part of the thesis a detailed presentation of contracting relations from the FIDIC's Red Book will be given. These prove themselves to be a more effective, inexpensive and faster way of solving the deviations that occur during construction. To enable a faster and easier reading of these procedures, I created a graphical representation of the diagrams which present the processes of individual events connected with a regular occurrence of deviations. The final finding is that the diagrams enable the overall review of all the procedures, reading them becomes faster and more comprehensible.

Abstract (ePrints): Gradnja je zahteven in dolgotrajen proces pri katerem prihaja velikokrat do dogodkov, ki povzročijo odstopanja, katera lahko vodijo do spora med pogodbenimi strankami. Vzroke za to lahko med drugim iščemo tudi v slabo pripravljeni gradbeni pogodbi. S podpisom gradbene pogodbe se namreč izvajalec zaveže, da bo dela izvedel, naročnik pa se zaveže, da mu bo za to delo plačal določeno ceno, zato mora biti gradbena pogodba sestavljena skrbno in premišljeno. Diplomsko nalogo razdelimo na dva dela. V prvem delu diplome se tako posvetimo teoretičnim izhodiščem, kjer se osredotočimo na splošne pojme pravnih virov, ki urejajo pogodbena razmerja med strankami v skladu z našo zakonodajo, v nadaljevanju pa predstavimo, kako ta razmerja ureja mednarodna organizacija FIDIC. Najprej sledi opis splošnih pogojev FIDIC, njihova uporabnost in razvoj skozi zgodovino, njihovo poznavanje pri nas ter skladnost z našo zakonodajo. V drugem delu naloge podrobno predstavimo pogodbene odnose po Rdeči knjigi FIDIC, ki se izkažejo kot učinkovitejši, hitrejši in cenejši način usklajevanja odstopanj pri gradnji med pogodbenimi strankami. Za lažje in hitrejše branje teh postopkov izdelamo grafičen prikaz diagramov poteka procesov za posamezne dogodke oziroma okoliščine pri katerih najpogosteje prihaja do možnih odstopanj. Ugotovimo, da nam diagrami bistveno poenostavijo celoten pregled teh postopkov, branje je hitrejše in bolj razumevajoče.
